Terms of Service

1. Acceptance of Terms

Your right to access and use the Site is conditional on your full acceptance of these Terms and our Privacy Policy. Continued use of the Site after any updates to these Terms (posted on the Site) constitutes your acceptance of the revised provisions. If you do not agree to these Terms in their entirety, you must immediately cease accessing or using the Site.

2. Eligibility Criteria

By using the Site, you represent and warrant that:
  • You are at least 18 years of age, or have reached the age of majority in your jurisdiction (whichever is higher);
  • You possess the legal capacity to enter into binding contractual agreements.
If you are a minor (under the age of 18 or the local age of majority), you may only use the Site with the explicit consent and supervision of a parent or legal guardian. The guardian assumes full responsibility for all actions conducted through the minor’s account, including compliance with these Terms.

3. Account Creation and Security

Registration Requirements

When creating an account on the Site, you agree to provide accurate, complete, and up-to-date information (e.g., contact details, account credentials). Falsifying or omitting information may result in account suspension or termination.

Security Obligations

You are solely responsible for maintaining the confidentiality and security of your account credentials (e.g., username, password). This includes protecting against unauthorized access, use, or disclosure of your account. If you suspect any unauthorized use of your account, a breach of security, or misuse of your credentials, you must notify our support team immediately at [email protected]. We shall not be liable for any losses, damages, or unauthorized activities resulting from your failure to safeguard your account.

4. Site Content and Information Accuracy

Accuracy of Information

We strive to ensure that all content on the Site (including descriptions, details, and guidance) is accurate, complete, and up-to-date. However, we do not warrant or guarantee that such content is free from errors, omissions, or inaccuracies. We reserve the right to correct any errors or update content at any time without prior notice.

Visual Display Disclaimer

Colors, images, and other visual elements on the Site may appear differently on your device due to variations in screen settings, resolution, or lighting. We cannot guarantee that the visual representation of Site content will match the actual experience, and such differences do not constitute a basis for claim or dispute.

5. Pricing and Fee Policy

Price/Fee Adjustments

We reserve the right to modify prices, fees, or charges for Site services at any time, without prior notice. Such adjustments may reflect changes in operational costs, market conditions, or regulatory requirements. The price/fee in effect at the time you submit a service request will apply, unless the request is rejected or cancelled.

Taxes

All prices and fees displayed on the Site exclude applicable taxes (e.g., sales tax, value-added tax) unless explicitly stated otherwise. Taxes will be calculated and added to your total at checkout, in accordance with local laws and regulations in your jurisdiction.

6. Service Request Acceptance Policy

Right to Refuse or Limit Requests

Your submission of a service request through the Site constitutes an offer to engage with our services. We reserve the right to accept, reject, or limit such requests at our sole discretion. Reasons for refusal or limitation may include, but are not limited to, suspicious activity, incomplete information, or capacity constraints.

Verification Requirements

We may request additional information (e.g., identity verification, billing address confirmation) before accepting a service request. This step is intended to prevent fraud, ensure compliance with legal requirements, and protect both you and our organization. Failure to provide requested verification may result in delayed processing or refusal of your request.

7. Delivery and Fulfillment Information

Processing Time

Most service requests are processed within 1–3 business days after payment confirmation or request submission. Please note:
  • No processing, fulfillment, or delivery occurs on weekends or major public holidays observed in the U.S. or Canada.
  • For requests with fulfillment to Canada, an additional 1–2 business days may be required to prepare mandatory customs documentation and verify shipping details. This ensures compliance with Canadian import regulations and helps avoid border delays.

Fulfillment Tracking

When available, tracking information for your fulfillment will be provided via email once your request is dispatched. Tracking updates may vary by carrier and jurisdiction—for the most up-to-date status, refer to the tracking link provided in your confirmation email.

8. Returns and Refunds

Return Eligibility

Eligible requests may be returned or cancelled within 30 days of delivery or fulfillment, provided they meet our return criteria (outlined in our dedicated Return Policy).

Non-Returnable Items/Services

Certain offerings—including promotional or clearance services, and gift cards (if applicable)—are non-refundable and non-returnable. These exclusions are clearly indicated at the time of request or purchase.

Refund Method

Approved refunds will be issued to your original payment method. Please allow additional time for your financial institution to process the refund (timelines vary by bank and are outside our control).

9. Canada Fulfillment – Duties & Taxes

For requests with fulfillment to Canada, any customs duties, taxes, or import fees imposed by Canadian authorities (e.g., Canada Border Services Agency) or shipping carriers are the sole responsibility of the recipient. These fees are not included in the request total and must be paid upon or after delivery.
In the event of an eligible return or refund for Canadian fulfillment:
  • Refunds will include the request amount and (if required by Canadian law) the original fulfillment fee—only if the return is due to our error (e.g., incorrect fulfillment).
  • Customs duties, taxes, or import fees paid by the recipient are non-refundable, as they are collected directly by government authorities or carriers.

10. Cross-Border Data Transfer & Privacy

Our operations are based in the United States. If you are located in Canada or another country outside the U.S., your personal data may be transferred to and processed in the U.S. We implement reasonable safeguards to protect your data, including encryption, secure data storage, and contractual agreements with service providers (e.g., data processing agreements), ensuring compliance with applicable data protection laws.
Canadian customers retain rights under Canadian privacy legislation, including the right to access, correct, or request deletion of their personal information. To exercise these rights, please contact our support team at [email protected].

  • Interfering with the normal operation of the Site, including disrupting servers, networks, or other users’ access;
  • Using the Site for commercial purposes not explicitly authorized in writing by D. Jones Standard Studio.

13. Limitation of Liability

To the fullest extent permitted by applicable law, D. Jones Standard Studio and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services. This includes, but is not limited to, lost profits, lost data, or damages due to inconvenience, even if we have been advised of the possibility of such damages. Our total liability for any claims related to the Site or services shall be limited to the amount you paid for the specific service in question (if applicable).

14. Changes to Terms

We may update or revise these Terms periodically to reflect changes in our operations, legal requirements, or industry standards. When we make changes, we will post the revised Terms on the Site with an updated "Last Updated" date. The changes will take effect immediately upon posting. We encourage you to review these Terms regularly—your continued use of the Site after the revised Terms are posted constitutes your acceptance of the changes.

15. Dispute Resolution Process

Any disputes, claims, or controversies arising out of or in connection with these Terms, your use of the Site, or our services shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without giving effect to any conflict-of-law rules or principles that would require application of the laws of another jurisdiction.
All such disputes shall be resolved exclusively through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its applicable commercial arbitration rules. The seat of arbitration shall be in the State of North Carolina, USA, and all arbitration proceedings shall be conducted in English. By agreeing to these Terms, you waive the right to pursue claims in court, participate in a class action lawsuit, or have a jury trial.
Nothing in these Terms is intended to restrict, limit, or waive any statutory rights you may be entitled to under consumer protection laws applicable in your jurisdiction—such rights remain in full force and effect and cannot be excluded by contract.
